The court in a divorce proceeding or an independent proceeding may make an order protecting the victim of domestic violence from contact with or harassment by the perpetrator of the violence. These orders also may include a residence exclusion (kick-out) order requiring the perpetrator to move out of the joint residence, an order prohibiting phone or personal contact by the perpetrator with the victim, and an order that the perpetrator stay a specified distance from the victim. Such an order is commonly referred to a “CLETS” order. A charge of domestic violence can have serious consequences since if the CLETS order is entered, the restrained person must surrender any firearms in his or her possession or control. A finding of domestic violence will also be considered by the court in awarding spousal support and making child custody and visitation orders. However, a charge of domestic violence that is found not to be supported by the evidence may be the basis for an award of sanctions or for a change in custody of the children.
