Domestic violence is an issue in many divorces, although by no means all. The court in a divorce proceeding (or another, independent proceeding) may issue a protective order to prevent the alleged perpetrator of the violence from contact with, stalking, or harassment of the victim.

However, a charge of domestic violence that is found not to be supported by the evidence may be the basis for an award of sanctions—or for a change in custody of the children.

Such an order is commonly referred to a “CLETS” order. A charge of family or domestic violence can have serious consequences, since if the CLETS order is entered, the restrained person must surrender any firearms in his or her possession or control. A finding of domestic violence or criminal domestic violence conviction will also be considered by the court in awarding spousal support and in making child custody and visitation orders.
